The PERM labor certification program for business employers within the United States is administered through the U.S. Department of Labor. It is essentially a series of steps that an employer goes through in order to be able to bring foreign workers into the country and employ them—easier said than done.
In simple terms, three things have to happen before the potential employer can receive an approved Labor Certification from the Department of Labor:
The employer must advertise for the positions to be filled within the United States for a specified period of time.
The prevailing wage rate for the position and skill level in the geographical area must be determined by the appropriate State Workforce Agency and the foreign worker’s pay must meet or exceed that wage.
The employer must demonstrate, after advertising for the positions at the proper wage rate, that there no minimally qualified U.S. workers responding to meet their needs.
There are other conditions and steps along the way, but a large part of the work in obtaining these certifications has to do with planning for, and coordinating this process.
